1. Agreement to Terms

By accessing our website or engaging ASCND Club for services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

2. Services

ASCND Club provides digital marketing, lead generation, CRM automation, website development, SEO, social media management, and related growth services exclusively for home service contractors. Specific deliverables, timelines, and pricing are outlined in individual service agreements.

3. Payment

Payment terms are established per client agreement. Invoices are due upon receipt unless otherwise specified in writing. ASCND Club reserves the right to pause or terminate services for non-payment after reasonable notice.

4. Intellectual Property

All creative assets, ad copy, and materials produced by ASCND Club remain the intellectual property of ASCND Club until full payment is received, at which point ownership transfers to the client as specified in the service agreement.

5. Client Responsibilities

Clients are responsible for providing accurate business information, timely feedback, and access to required accounts and platforms. Delays caused by the client may affect timelines and deliverables.

6. Limitation of Liability

ASCND Club is not liable for indirect, incidental, or consequential damages arising from use of our services, including but not limited to lost profits, lost revenue, or business interruption. Our total liability shall not exceed the amount paid for services in the 30 days preceding the claim.

7. No Guarantee of Results

While we strive for measurable outcomes, ASCND Club does not guarantee specific lead volumes, revenue figures, or ROI. Results vary based on market conditions, client responsiveness, budget, and other factors outside our control.

8. SMS Communications

By providing your phone number, you consent to receive SMS/MMS messages from ASCND Club. You may opt-out at any time by replying STOP. See our SMS Disclosure for full details.

9. Termination

Either party may terminate services with written notice as specified in the service agreement. Fees for work completed prior to termination remain due and payable.

10. Governing Law and Jurisdiction

These Terms & Conditions and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Oregon. Any legal action or proceeding relating to these terms shall be brought exclusively in the state or federal courts located in Portland, Oregon, and both parties consent to the personal jurisdiction of such courts.

11. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. Updated terms will be posted on this page. Continued use of our services constitutes acceptance of the revised terms.
